1. Acceptance of Terms

By accessing or using TalentGPT ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. License & Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.

You may not: (a) modify, reverse engineer, or create derivative works; (b) resell or redistribute the Service; (c) use the Service for illegal purposes; (d) scrape or harvest data from the Service; or (e) circumvent technical limitations.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe intellectual property rights of others
  • Discriminate on the basis of protected characteristics
  • Upload malicious code or attempt to compromise security
  • Impersonate others or provide false information

4. Payment & Refunds

Fees are charged monthly or annually as specified in your plan. Payment is due in advance. We accept credit cards and wire transfers for annual plans.

Refunds are available within 7 days of initial purchase if you've used fewer than 100 evaluated views. After 7 days or 100 views, all fees are non-refundable.

5. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE HIRING OUTCOMES, CANDIDATE QUALITY, OR ACCURACY OF PREDICTIVE SIGNALS.

TalentGPT is a pre-evaluation tool, not a background check service or consumer reporting agency. You remain responsible for final hiring decisions and compliance with employment laws.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID IN THE PRIOR 12 MONTHS.

7. Indemnification

You agree to indemnify and hold harmless TalentGPT from any claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

8. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka.

For disputes under ₹10,00,000, we encourage good-faith negotiation before litigation. Larger disputes may proceed to arbitration under Indian Arbitration and Conciliation Act.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email 30 days in advance. Continued use after changes constitutes acceptance.
